How do Miranda rights apply to non-citizens?

The U.S. Constitution provides a number of rights to citizens in this country. Many people don’t know that some of those rights extend to anyone who is on U.S. soil, regardless of their immigration status. The “Miranda rights” are some of the most commonly referred to in this country, so immigrants may be curious about how those rights apply to them.

In late 2023, a federal appeals court issued a ruling that Miranda rights aren’t required if immigration officers are making an arrest using a warrant. The reasoning behind this is simple. Immigration is a civil matter, and the Miranda rights only apply to criminal matters.

With this ruling, it is clear that while immigrants must be read their Miranda rights if they’re in a custodial interview for a criminal matter, it is not required that those rights be given to them if the warrant is related to immigration.
