Can a fiance with a K-1 visa travel abroad before the wedding?

Falling in love with someone who lives in another country creates a variety of challenging scenarios. United States citizens with foreign fiances can apply for a K-1 fiance visa as long as the couple marries within 90 days. Their partner can legally enter the country after they secure a K-1 visa.

Fiances with K-1 visas may face family emergencies or other situations that require them to travel back to their home countries. Can a fiance with a K-1 visa leave the United States and then return to get married?

K-1 visas authorize a single entry

K-1 visas only offer limited immigration protection for foreign national fiances. There is an expectation that the couple should marry within 90 days of the foreign national fiance entering the country. They can then apply to adjust their status and secure a conditional green card.

Until they have acquired a green card, they likely cannot leave the United States without risk. A K-1 visa is a single-entry visa. Once a foreign national fiance has entered the country, they cannot exit it again and re-enter.

They may find themselves denied re-entry after traveling abroad, even if a family emergency requires their presence. In unusual circumstances, people can apply in advance to secure the right to re-enter the country if they leave while holding a single-entry visa.

For the most part, avoiding international travel is necessary for those who enter the country for the express purpose of getting married. Learning more about the rules that govern K-1 visas can help engaged couples avoid common pitfalls that could complicate their plans.
